These terms govern your access to and use of CreditorReady. This page is a plain language summary and should be reviewed by counsel before launch.
1. Acceptance of terms
By accessing or using CreditorReady, you agree to these terms and to use the platform responsibly and in compliance with applicable laws.
2. Platform description
CreditorReady is a neutral marketplace and software venue that helps credit teams and recovery agencies exchange RFPs, proposals, profile information, messages, and related marketplace activity. CreditorReady is not a party to any agreement, engagement, or transaction between a credit team and an agency.
3. Account registration
You agree to provide accurate account information and to keep it current. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials.
4. User roles
Credit managers create and manage RFPs. Agencies build profiles, browse RFPs, and submit proposals. Access depends on your account type.
5. User content and conduct
RFPs, proposals, agency profiles, and messages are created by users of the marketplace. CreditorReady does not create, verify, endorse, or take responsibility for any claim, representation, statement, promise, or assertion made by any credit team or collection agency anywhere on this platform. Each party is responsible for its own independent diligence. You are solely responsible for the content you submit, and you agree not to post content that is false, misleading, unlawful, or that infringes the rights of others.
6. No verification or endorsement
CreditorReady does not independently verify the identity, licensing, qualifications, statements, or representations of any user, and listing or approval of an agency reflects marketplace access only. It is not an endorsement, recommendation, or assessment of performance, compliance, or suitability for any specific RFP.
7. Independent diligence
Each party is responsible for conducting its own due diligence before entering any engagement. Final vendor selection rests with the credit team. CreditorReady is not responsible for, and disclaims all liability arising from, any decision made or any claim, promise, or representation made by any credit team or agency.
8. No professional advice
CreditorReady does not provide legal, financial, compliance, collections, or investment advice. Nothing on the platform is a substitute for advice from a qualified professional.
9. No guarantee of outcomes
CreditorReady does not guarantee recovery results, agency performance, collection outcomes, regulatory compliance, proposal accuracy, response volume, or engagement success.
10. Disclaimer of warranties
The platform is provided on an as is and as available basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, CreditorReady is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the platform or from any interaction, agreement, or dispute between users.
12. Indemnification
You agree to indemnify and hold CreditorReady harmless from claims, damages, and expenses arising from your content, your use of the platform, or your engagements with other users.
13. Termination
We may suspend or terminate access for conduct that violates these terms or harms the marketplace.
14. Changes to terms
We may update these terms as the product matures. Material changes will be communicated before they take effect.
